FIBICO's contractual regime, the abbreviation of Fundación para la Investigación Biomédica de Córdoba, results from its status as a foundation registered in the Registry of Foundations of the Autonomous Community of Andalusia, governed by Law 10/2005 of 31 May. FIBICO has the status of a contracting authority without the character of a Public Administration, in accordance with the provisions of art. 26 of Law 9/2017 of 8 November on Public Sector Contracts (hereinafter LCSP). IMIBIC, for its part, is a health research institute created on 24 April 2008 within FIBICO and subsequently developed by an agreement signed on 9 September 2008 between the Regional Ministry of Health of the Government of Andalusia, the Regional Ministry of Innovation, Science and Enterprise of the Government of Andalusia, the Andalusian Health Service, FIBICO and the University of Córdoba, and which is accredited as a Health Research Institute by the Ministry of Health.
FIBICO's contracts are private in nature and shall be governed by the provisions of Title I of Book Three of the LCSP as regards their preparation and award. As regards their effects and termination, the rules of private law shall apply, as well as those rules referred to in the first paragraph of article 319 concerning environmental, social or labour matters, special performance conditions, contract modification, assignment and subcontracting, and technical rationalisation of procurement; and the ground for contract termination relating to the impossibility of carrying out or performing the service under the terms initially agreed, when it is not possible to modify the contract in accordance with articles 204 and 205.
Within this type of contract, the LCSP distinguishes, as regards their award, between contracts subject to harmonised regulation and those that are not. The preparation and award of the former is governed by the rules established in Sections 1 and 2 of Chapter I of Title I of Book II of the LCSP pursuant to art. 317 of that Law.
This Foundation, in compliance with the principle of transparency in procurement and the effectiveness and efficiency of administrative action, encourages and prefers the use of electronic, computer and telematic means in the procedures provided for by the Law by bidding and candidate companies.
Therefore, the Fundación para la Investigación Biomédica de Córdoba will use the State Procurement Platform (Plataforma de Contratación del Estado) as the means of communication with companies for conducting public tenders for the procedures that so require, and also to comply with Law 19/2013 of 9 December on transparency, access to public information and good governance. This means of communication complies with the regulations applicable to public procurement and contracting authorities, providing maximum dissemination and transparency to procurement processes.
